AGREEMENT OF RELEASE AND WAIVER OF LIABILITY
By signing this waiver, I < The Client> hereby agree to the following:
1. That I am participating in the health and fitness Private/ Semi-Private sessions and programs that are offered by PURE FUNCTION INC., PURE FUNCTION FITNESS CENTER, during which I will receive information and instruction about health and fitness. I recognize that fitness programs and classes require physical exertion that may be active/dynamic and may cause physical injury, and I am fully aware of the risks and hazards involved.
2. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the health fitness programs and Private/Semi-Private training sessions. I represent and warrant that I am physically fit and have no medical condition that would prevent my full participation in the fitness programs and or Private training sessions.
3. In consideration of being permitted to participate in health and fitness programs and Private/Semi-Private sessions, I agree to accept full responsibility for any risks, injuries, or damages known or unknown, which I might incur as a result of participating in the programs or training sessions.
4. In consideration of being permitted to participate in health and fitness programs and/or Private/ Semi-Private training sessions, I knowingly, voluntarily and expressly waive any claim I may have against PURE FUNCTION INC., PURE FUNCTION FITNESS CENTER and or its owners for injury or damages that I may sustain as a result of participating in the program or training sessions or from accidents on any pieces of equipment located in the studio or any accidents on the premises of the fitness studio.
5. I acknowledge the contagious nature of the Coronavirus/COVID-19 and that the CDC and many other public health authorities still recommend practicing social distancing.
I further acknowledge that PURE FUNCTION FITNESS CENTER has put in place preventative measures to reduce the spread of the Coronavirus/COVID-19.
I further acknowledge that PURE FUNCTION FITNESS CENTER cannot guarantee that I will not become infected with the Coronavirus/Covid-19. I understand that the risk of becoming exposed to and/or infected by the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of myself and others, including, but not limited to, studio staff, trainers and other studio clients and their family members.
I voluntarily seek services provided by PURE FUNCTION FITNESS CENTER and acknowledge that I am increasing my risk to exposure to the Coronavirus/COVID-19. I acknowledge that I must comply with all set procedures to reduce the spread while attending my appointment.
I attest that:
* I am not experiencing any symptom of illness such as cough, shortness of breath or difficulty breathing, fever, chills, repeated shaking with chills, muscle pain, headache, sore throat, or new loss of taste or smell.
* I have not traveled internationally within the last 14 days.
* I have not traveled to a highly impacted area within the United States of America in the last 14 days.
* I do not believe I have been exposed to someone with a suspected and/or confirmed case of the Coronavirus/COVID-19.
* I have not been diagnosed with Coronavirus/Covid-19 and not yet cleared as non-contagious by state or local public health authorities.
* I am following all CDC recommended guidelines as much as possible and limiting my exposure to the Coronavirus/COVID-19.
I hereby release and agree to hold PURE FUNCTION INC., PURE FUNCTION FITNESS CENTER and its owners harmless from, and waive on behalf of myself, my heirs, and any personal representatives any and all causes of action, claims, demands, damages, costs, expenses and compensation for damage or loss to myself and/or property that may be caused by any act, or failure to act of the studio, or that may otherwise arise in any way in connection with any services received from Pure Function Fitness Center.
6. I understand that this release discharges PURE FUNCTION INC., PURE FUNCTION FITNCESS CENTER and or its owners from any liability or claim that I, my heirs, or any personal representatives may have against the studio with respect to any bodily injury, negligence, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from PURE FUNCTION INC., PURE FUNCTION FITNESS CENTER. This liability waiver and release extends to the studio together with all owners, partners, and employees.
I have read the above release and waiver of liability and fully understand its contents. I voluntarily agree to the terms and conditions listed and stated above.
