MEMBERSHIP CONTRACT TERMS AND CONDITIONS
This membership contract is entered into on [Date] between
[Durango Fitness Club] and [Member Name]
1. Membership. The Member is hereby granted membership in the Durango Fitness Club, subject to the terms and conditions set forth in this Agreement.
2. Term. This Agreement shall be effective as of the date signed by the Member and shall continue until terminated by either party in accordance with the terms of this Agreement.
3. Fees. The Member shall pay the Club a monthly of $95.00 membership fee in the amount set forth in the membership agreement. The first payment shall be due upon execution of this Agreement, and subsequent payments shall be charged on the same date of each month thereafter.
4. Reoccurring fees. All memberships are set on a reoccurring monthly payment schedule. Membership fees will continue until member cancels their membership.
5. Use of Facilities. The Member shall have access to the Club’s facilities during normal operating hours, subject to the rules and regulations established by the Club.
6. Health and Safety. The Member acknowledges that the use of the Club’s facilities may involve risks of injury, and agrees to use such facilities at his or her own risk. The Member represents that he or she is in good physical
condition and is capable of using the facilities without endangering his or her health. The Member agrees to comply with all health and safety rules established by the Club, and to use the facilities in a safe and responsible
manner.
7. Termination. Either party may terminate this Agreement upon written notice to the other party. If the Member terminates this Agreement.
A. Termination by Member. A member may terminate his or her club
membership at any time by providing written notice to the Club. Such notice must be delivered to the Club at least [3] days prior to the next billing cycle.
B. Early Termination Fee. If a member terminates his or her gym membership prior to the end of the current billing cycle, the member shall maintain access to the club for the remainder of that cycle.
C. Termination by Club. The Club may terminate a member’s Club membership for cause, including but not limited to, violation of the Club’s rules and regulations, failure to pay membership fees, or conduct deemed inappropriate by the Club. Cause for termination may include but not limited to; rude behavior, harassment of staff or members, abuse or destruction of property, foul language, being intoxicated, discriminatory language or behavior.If the Club terminates a member’s club membership for cause, the member shall not be entitled to a refund of any membership fees.
8. Refund of Membership Fees. If a member terminates his or her gym membership in accordance with this Policy, the Club has sole discretion to refund any unused portion of the membership fees paid by the member.
9. No Refund for Late Termination Fee. If a member is required to pay an early termination fee under this Policy, such fee shall not be refundable.
10. Governing Law. This Policy shall be governed by and construed in accordance with the laws of the state in which the Gym is located.
11. Entire Agreement. This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof, and supersedes all prior negotiations, understandings and agreements between the parties, whether written or oral.
