1. I have been examined by a licensed physician within the past six months and have been found by such physician to be in good physical health;

2. I am an in good physical health at the date of this declaration and physically able to perform all of the vigorous stretching and strengthening yoga exercises that I am to learn and perform during my enrolment with Bikram Yoga Darlinghurst.

3 I am not pregnant.

4. I have informed Bikram Yoga Darlinghurst, its owners, teachers, contractors, agents and employees of all of my current or previous injuries, surgeries, illnesses, medical conditions and medications.

5. I have been made aware that there are inherent risks of injury when undertaking the vigorous stretching and strengthening yoga exercises that I am to learn, practice and perform during my enrolment with Bikram Yoga Darlinghurst, including but not limited to sprain, strain, muscle pull, dislocation, tear dehydration, separation or cramp.

6. I will faithfully follow all instructions given to me by Bikram Yoga Darlinghurst, its owners, teachers, contractors, agents or employees as to when, where, and how to perform and not to perform the yoga exercises I am to learn, practice and perform during my enrolment with Bikram Yoga Darlinghurst, and any deviation by me from such instructions is entirely at my own risk.

7. I am to receive instruction in general yoga theory and exercises only. I do not expect Bikram Yoga Darlinghurst, its owners, teachers, contractors, agents or employees to provide any advice, training or medical assistance other than in the form of general yoga stretching and strengthening exercises.

8. My image may be used during distribution of live or recorded online video classes or captured for marketing purposes.

I acknowledge and agree that Bikram Yoga Darlinghurst, its owners, teachers and employees rely upon the truth and accuracy of the above confirmations in the provision of the vigorous stretching and strengthening yoga exercises that I am to learn, practice and perform during my enrolment with Bikram Yoga Darlinghurst.

Assumption of Risk and Waiver and Release of Liability

I acknowledge and agree that:

(a) I assume any risk of injury, death, loss or damage suffered or incurred by me caused in whole or in part by my participation in the vigorous stretching and strengthening yoga exercises that I am to learn, practice and perform during my enrolment with Bikram Yoga Darlinghurst or by any physical impairment of mine not fully disclosed to Bikram Yoga Darlinghurst in writing, including but not limited to any such injury, death, loss or damage suffered or incurred in connection with:

(i) my failure to faithfully follow the instructions of by Bikram Yoga Darlinghurst, its owners, teachers and employees; and

(ii) my participation in any classes convened remotely by Bikram Yoga Darlinghurst, its owners, teachers, contractors, agents and employees; and

(b) I release, without limitation, Bikram Yoga Darlinghurst, its owners, teachers, contractors, agents and employees from any claim in connection with any such injury, death, loss or damage of whatever nature.

(c) I will notify staff that my image not be captured and utilize area(s) provided.

I understand that the above waiver and release means I give up my right to bring any claims in connection with any such injury, death, loss or damage of whatever nature and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.

Coronavirus/COVID-19 - assumption of Risk and Waiver and Release of Liability

I further acknowledge and agree that:

1. Bikram Yoga Darlinghurst, its owners, teachers, contractors, agents and employees cannot prevent me from becoming exposed to, contracting or spreading Coronavirus / COVID 19 while utilizing their services or premises and it is not possible for them to prevent against the presence of Coronavirus / COVID 19;

2. I have read and understood the above warning concerning Coronavirus / COVID 19 and hereby voluntarily assume the risk that I may be exposed to or infected by Coronavirus /COVID-19 by utilizing the services or premises of Bikram Yoga Darlinghurst, its owners, teachers, contractors, agents and employees and that such exposure or infection may result in personal injury, illness, permanent disability, and death;

3. I hereby forever release and waive any claims against Bikram Yoga Darlinghurst, its owners, teachers, contractors, agents or employees in connection with exposure, infection, and/or spread of COVID-19 related to utilizing their services and premises, and whether or not a Coronavirus / COVID-19 infection occurs before, during, or after participation in their services during my enrolment with Bikram Yoga Darlinghurst.

I understand that the above waiver and release means I give up my right to bring any claims in connection with any such injury, death, loss or damage of whatever nature and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.

I HAVE CAREFULLY READ AND FULLY UNDERSTAND ALL PROVISIONS OF THIS DOCUMENT, AND FREELY AND KNOWINGLY ASSUME THE RISK AND WAIVE MY RIGHTS AND PROVIDE MY RELEASE CONCERNING LIABILITY AS DESCRIBED ABOVE:
