1) In consideration of being allowed to participate in the activities and programs of FLEXX fitness located at 1356 Beverly Road, McLean, Virginia, 22101, and to use its facility, equipment and machinery in addition to the payment of any fee or charge, I do hereby waive, release and forever discharge FLEXX fitness and its officers, agents, employees, independent contractors representatives, executors, and any and all others from any and all responsibilities or liability from injuries or damages to myself in any way arising out of participation in any activities, or my use of equipment or machinery, at FLEXX fitness.

2) I understand and am aware that strength, flexibility, and aerobic exercise, including the use of equipment, is a potentially hazardous activity. I also understand that fitness activities involve a risk of injury and even death and that I am voluntarily participating in these activities and using equipment and machinery with knowledge of the dangers involved. I hereby agree to expressly assume and accept any and all risks of injury or death.

3) I do hereby further declare myself to be physically sound and suffering from no condition, impairment, disease, infirmity or other illness that would prevent my participation in any FLEXX fitness activities or the use of equipment or machinery except as hereinafter stated. I acknowledge that I have had either i) a physical examination and received my physician’s permission to participate, or ii) I have decided to participate in FLEXX fitness activities and use of the equipment and machinery without the approval of my physician and do hereby assume all responsibility for my participation in FLEXX fitness activities and the utilization of equipment and machinery in my activities.

4) I fully understand that I may cause serious injury or death to myself or to other people around me by using the facility equipment and machinery without the assistance or guidance of a personal trainer or exercise instructor. I hereby expressly assume and accept any and all risks of injury or death to myself or to other people around me and release FLEXX fitness, its owners, employees, independent contractors, officers, agents, representatives, executors and all others from any claims, demands and causes of action arising from my using the facility, equipment and machinery without the assistance of a personal trainer or exercise instructor.
