In consideration of gaining membership and being allowed to participate in the classes, outdoor rides, events, activities and programs (“activities”) of QT2 Systems, LLC (D.B.A. CycleLife Studio) and to use its facilities, equipment, indoor cycles, computrainers (individually or together as “equipment”) and to receive advice and coaching from staff about topics including, but not limited to, proper technique and form, use of equipment, and training routines, in addition to the payment of any fee or charge, I do hereby waive, release and forever discharge QT2 Systems, LLC, and its members, managers, agents, employees, representatives, independent contractors, executors and any others acting upon their behalf from any and all responsibilities or liability for injuries or damages including damages to myself resulting from my participation in any activities at CycleLife Studio, or arising out of or connected to my participation in any activities at CycleLife Studio, or use of equipment, and including any damages or injuries that may be caused by the negligent act or omission of QT2 Systems, LLC, and its members, managers, agents, employees, representatives, independent contractors, executors and any others acting upon their behalf. Furthermore, I understand and am aware that activities including but not limited to strength and flexibility training, cycling, triathon, running, swimming, and aerobic and anaerobic exercise, including the use of equipment, are potentially hazardous activities. I also understand that fitness activities involve a risk of injury and even death, and I expressly declare that I am voluntarily participating in these activities and using equipment with knowledge of the dangers involved. I do hereby defend, indemnify and hold harmless QT2 Systems, LLC, and its members, managers, agents, employees, representatives, independent contractors, executors and any others acting upon their behalf for any claim I or my heirs or assigns may have, and I expressly assume and accept any and all risks of injury or death. I irrevocably waive any claim I or my heirs or assigns may have against QT2 Systems, LLC and its members, managers, agents, employees, representatives, independent contractors, executors and any others acting upon their behalf for any risk of injury or death. I do hereby further declare myself to be physically sound and suffering from no condition, disease, infirmity or other illness that would prevent my participation in any activities of CycleLife Studio or that would prevent my use of equipment at CycleLife Studio. I hereby acknowledge that I have been informed of the need for a physician’s approval for my participation in an exercise or fitness activity and/or in the use of the equipment. I acknowledge and expressly declare that I have either had a physical examination and have been given a physician’s permission to participate or that I have decided to participate in activities and/or use of equipment without the approval of a physician and do hereby assume all responsibility for my participation and activities and utilization of any equipment.

 

In consideration for storing my bicycle or other athletic gear or equipment (“bicycle”) on premises at CycleLife Studio (“storage”), in addition to the payment of any fee or charge, I do hereby waive, release and forever discharge QT2 Systems, LLC, and its members, managers, agents, employees, representatives, independent contractors, executors, insurers and any others acting upon their behalf from any and all responsibilities or liability for injuries, loss or damages including damages to my bicycle or loss of my bicycle resulting from such storage, and including any damages or injuries that may be caused by the negligent act or omission of QT2 Systems, LLC, and its members, managers, agents, employees, representatives, independent contractors, executors, insurers and any others acting upon their behalf. Furthermore, I understand and am aware that I am responsible for obtaining and maintaining insurance coverage for my bicycle, regardless of where stored. I expressly declare that I am voluntarily storing my bicycle on CycleLife Studio’s premises, and I do hereby defend, indemnify and hold harmless QT2 Systems, LLC, and its members, managers, agents, employees, representatives, independent contractors, executors, insurers and any others acting upon their behalf for any claim I or my heirs or assigns may have for loss of or damage to my bicycle, and I expressly assume and accept any and all risks of damage to or loss of my bicycle. I irrevocably waive any claim I or my heirs or assigns may have against QT2 Systems, LLC and its members, managers, agents, employees, representatives, independent contractors, executors, insurers and any others acting upon their behalf for any risk of damage too or loss of my bicycle.
