I waive my rights to any claim, cause of action, and/or the right to file a lawsuit against Ayala Royal Ballet, or against any of its affiliates, directors, officers, sponsors, and employees, I further release all such organizations and/or persons from any and all responsibility or liability of any nature whatsoever for any loss or damage to my person or property, including, but not limited to, a personal injury sustained on or through the Program. The use of the premises is for class only, which includes an instructor as part of the curriculum for the semester. Any-time access to the facility is prohibited unless pre-approved by an instructor for a classroom-related activity.I hereby assume all responsibility and risk for any accidents.

 

 

I (Client and Signee) will indemnify Ayala Royal Ballet LLC, its employees, agents, and/or contractors, and third-party affiliates and save it harmless from and against any and all claims, actions, damages, liability, and expenses including reasonable attorney’s and other professional fees and costs at all trial and appellate proceedings in connection with loss of life, personal injury, third party and/or other students causing injury from verbal and/or physical acts of violence, life threat, assault, battery, defamation, verbal misconduct, and/or damage to property arising from or out of the occupancy or use by Client of the Premises and studio or any part thereof, or occasioned wholly or in part by any act or omission of Client, its officers, agents, contractors or employees or resulting from a violation of this agreement by the client.

 

The novel coronavirus, COVID-19 and all Covid-19 Variants and Mutations, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people. Ayala Royal Ballet LLC (“the Studio”) has put in place preventative measures to reduce the spread of COVID-19 and all Variants and Mutations; however, the studio cannot guarantee that you or your child(ren) will not become infected with COVID-19, Variants, and Mutations. Further, attending the Studio could increase your risk and your child(ren)’s a risk of contracting COVID-19 and all Variants and Mutations. By signing this agreement, I acknowledge the contagious nature of COVID-19, Variants, Mutations and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19, Variants, Mutations by attending the Studio and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19, Variants, Mutations at Ayala Royal Ballet may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Studio employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at the Studio or participation in Studio programming (“Claims”). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless the Studio, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Studio, its employees, agents, and representatives, whether a COVID-19, Variant or Mutation infection occurs before, during, or after participation in any Studio program.
