I, ________________________________________, hereby agree to the following on ___________________________:
1. That I understand physical exercise can be strenuous and be risk of serious injury, Fit Results LLC, Fit Results Logan Square LLC, Fit Results International LLC and any of their parents, subsidiaries, affiliates, franchisees and all of their assignees, owners, shareholders, members, employees, and agents (including all personal trainers and/or instructors) (collectively, the "Fit Results Parties") urge you to obtain a physical examination from a doctor before beginning any exercise or training program. I agree that by participating in these physical exercise session(s) or personal training activities, I do so entirely at my own risk. This includes, without limitation, (a) my use of all amenities and equipment in the facility and any off-site location; (b) my participation in any activity, class, program, personal training, or instruction; (c) the sudden and unforeseen malfunctioning of any equipment; and (d) the Fit Results Parties; instruction, training, supervision, or dietary inspiration. I agree that I am voluntarily participating in these activities and the use of equipment at the Fit Results Parties; facilities and off-site premises and assume all risks of injury.
2. I understand and warrant release, hold harmless and discharge the Fit Results Parties from all claims, demands, damages, rights of action, present and future therein. This waiver and release of liability includes, without limitation, all injuries to me which may occur, regardless of negligence on the part of any of the Fit Results Parties. If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severable here from.
3. I acknowledge that I have read this waiver and release and fully understand that it is a release of liability. I agree to voluntarily give up any right that I may otherwise have to bring a legal action against the Fit Results Parties for negligence, or any other personal injury or property damage or loss action.
4. I release all rights as well as use of any pictures or videos for promotional use that may be taken during classes to the Fit Results Parties, unless I specifically state I prefer not to be in such pictures or video footage.
