I hereby acknowledge my responsibility in communicating any physical and psychological concerns that might conflict with participation in such activity. I acknowledge that I am physically fit and mentally capable of performing the physical activity I choose to participate in at Los Gatos Orthopedic Sports Therapy and LGOST PRO.

In consideration for you being allowed to participate on site at Los Gatos Orthopedic Sports Therapy facility, you are required to comply with all posted rules and procedures. As a reminder, all rules and procedures are subject to change based on changes in public health guidance.

FAILURE TO COMPLY WITH THE HEALTH AND SAFETY MEASURES OUTLINED IN THIS DOCUMENT OR ANY UPDATED HEALTH AND SAFETY MEASURES MAY RESULT IN TERMINATION OF YOUR ON-SITE FITNESS PARTICIPATION AND/OR ACCESS TO FACILITIES, ALONG WITH THE LOSS OF PAID SESSION(S).

I acknowledge and voluntarily assume a risk of exposure to or infection with COVID-19 inherent in the attendance of both indoor and outdoor gatherings, and the possibility that such exposure or infection may result in personal injury, illness, permanent disability, and/or death. I understand that this acknowledgment does not waive any legal rights I might have. I will keep in mind that COVID-19 is extremely contagious.

While the LGOST PRO staff are implementing best practices to reduce the risk of spreading COVID-19, the LGOST PRO staff cannot eliminate this risk entirely. Even with best practices, it is not possible at this time to eliminate the risk of contracting COVID-19 while outside or in semi-public places, like Los Gatos Orthopedic Sports Therapy clinic or outside locations. I understand that as a client participating in indoor/outdoor training sessions with LGOST PRO, I must take adequate precautions to protect myself and others.

After having read this waiver in its entirety and understanding these facts, and in consideration of the acceptance of my participation and Los Gatos Orthopedic Sports Therapy furnishing services to me, I agree, for myself and anyone entitled to act on my behalf to HOLD HARMLESS, WAIVE AND RELEASE Los Gatos Orthopedic Sports Therapy and LGOST PRO, its officers, agents, employees, organizers, representatives, and successors from any responsibility, liabilities, demands, or claims of any kind arising out of my participation in any training with any of the exercise equipment at Los Gatos Orthopedic Sports Therapy 16615 Lark Ave Los Gatos, CA 95032.

By signature or accepting, I indicate that I have read and understood this Liability Waiver. I am aware that this is a waiver and a release of liability and I voluntarily agree to its terms. I also understand that any instruction from any agent of Los Gatos Orthopedic Sports Therapy and/or LGOST PRO does not constitute a doctor/patient relationship.

A parent's signature and/or acceptance of terms by a parent will be used in place of a child that is under 18 years of age, in order to acknowledge acceptance of all terms on the child's behalf.

I, the undersigned, herby give my consent to the Los Gatos Orthopedic Sports Therapy (LGOST), its agents and employee, and/or independent contractors representing public information media who are authorized by this office, for the performance of these photographic procedures or actions initialed below:

1. Taking of still photographs of patient/client/student.
2. Taking of motion pictures and video recordings of patient/client/student.
3. Use of any of the above initialed for scientific purposes or publication provide identity is not revealed in any manner.
4. Use of any of the above initialed for any purpose, including, but not limited to publications in newspapers, magazines, and other public/social media.

This consent is expressly intended to release from liability resulting from or attributable any of the procedures and actions authorized above, Los Gatos Orthopedic Sports Therapy, its agents, officers, employees, and independent contractors.
