Zero Point Yoga Liability Release and Disclaimer Deed

This disclaimer applies to out providing goods and services. You must sign this disclaimer before we will provide you with goods and services.
You acknowledge that all physical activity including our goods and services involve a risk of personal injury (including a risk of serious injury or death)
You take full responsibility and accept all liability for your health and well-being regarding our goods and services
You confirm that you suffer from no medical or physical condition or disability that may affect the normal risks associated with physical activity
You agree to complete and provide us with any questionnaire form we provide you regarding your physical well-being and medical history
You confirm that you will complete any questionnaire or form we provide you under clause 5 to the best of your knowledge
You agree to inform us as soon as possible if you experience or anticipate any pain, discomfort or injury in our provision of goods or services or if you suffer any physical injury or illness
You acknowledge that we rely on the representation in clauses 4,6 and 7 in providing you goods and services
Upon our request, you agree to provide us with written approval from your general practitioner before we provide you with goods and services
You agree to comply with all of our directions whilst consuming or participating in our goods and services
You agree that in addition to any other rights we have under this Disclaimer or at law, we may in our sole discretion cease to provide you with goods and services
You agree that to the maximum extent permitted by law, we exclude all representations, warranties, undertakings and guarantees relating to our goods and services
Without prejudice you agree that we do not represent, warrant, undertake or guarantee that:
You will not suffer injury arising from or in any way connected to our goods and services
Our goods and services will affect your physical well being measurably or at all; or
We will provide our goods and services for any period of time.
1. To the fullest extent lawfully possible, you agree to release, discharge and forever hold us harmless in respect of:
Any personal injury (including serious injury or death) that you may suffer arising from or in any way connected to consuming or participating in our goods and services and in respect of any losses arising from or connected to such injury;
Any loss or damage to property that you may incur arising from or in any way connected to consuming or participating in our goods and services; and
Any cancellation or ceasing of supply of our goods and services
2. You agree to indemnify us and keep us indemnified against any loss or damage that you (or anyone on your behalf) have suffered or may suffer or but for this Disclaimer could have suffered arising from or in any way connected to any personal injury (including serious injury or death) or loss or damage to property arising from or in any way connected your consuming or participating in our goods and services.
3. You agree that this Disclaimer is a bar against any claim by you (or anyone on your behalf) arising from or in any way connected to any personal injury (including serious injury or death) or loss or damage to property arising from or in any way connected your consuming or participating in our goods and services
4. Nothing in this Disclaimer limits or excludes our liability for personal injury or death or loss or damage to property:
Arising from or in any way connected to our wilfully destructive actions, gross negligence or fraud; or
In any way not permitted by law
5. If any clause in this Disclaimer is determined to be void, illegal or unenforceable:
It is to be read only so much as is required for it to be enforceable; and
The remaining clauses will continue in effect
This Disclaimer shall be governed by the law of Victoria and the parties submit to the non-exclusive jurisdiction of the courts and tribunals of Victoria
6. In this Disclaimer:
A reference to the singular includes plural and vice versa;
"Clause" means a clause of this Disclaimer;
"Disclaimer" means this Deed and its clauses;
"Goods and services" means yoga and fitness classes, therapeutic treatments, products and consults;
"Including" and similar words to not limit or prejudice;
"we" , "us" and "our" means Zero Point Yoga and includes (where relevant) its office holders, employees, agents and assigns;
"You" means the person signing and includes your agents and assigns. I have read and understood this Disclaimer and agree to its terms.
By agreeing to and signing this waiver you agree to read and abide by all terms and conditions listed on the website www.zeropointyoga.net and any and all other terms and conditions imposed by the studio.

SIGNED AS A DEED
