Liability waiver
"Agreement made today between MVEMENT LLC., a corporation organized and existing under the law of the state of Texas, with its principal office located at 7560 Greenville Avenue, Dallas, TX 75231, referred to herein as the Health Spa.
Whereas you desire to become a member of the Health Spa and cannot become a member without agreeing to rules and regulations set forth below and abiding by the terms of this Agreement;

Now, therefore, for and in consideration of the mutual covenants contained in this agreement, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledge, the parties agree as follows:

1. Check-In Policy
Members must check in each time they use the Health Spa using his/her current phone number at the front desk upon arrival. Health Spa usage may be denied if member does not have correct phone number or form of ID. The Health Spa may either close or operate at reduced hours on holidays. Business hours, policies, and regulations are subject to change without notice. However, Health Spa will do everything in its power to inform members of such changes in advance.

2. Fees and Cancellation
Monthly membership begins first of every month. Payment is accepted in form of credit card or ACH. Members who join after the first will be charged the month pro-rata on the day of joining, then on the first of the month moving forward. If member cancels 3 business days prior to the last day of the month, they will not be charged for another month’s membership. Outside of special circumstances, we do not offer refunds or reverse, prorated memberships. Anyone who cancels must obtain a confirmation number. This confirmation number is used for reference and proof of cancellation. The Health Spa will not accept claims without a confirmation number. Fees will not be charged to clients for late or missing payments, accounts will be placed on hold until membership is active and resumed.

3. Freeze Policy
Members can freeze their account in 2-week increments. No retroactive membership holds or refunds.

4. Drop-In Policy
Visitors with Health Spa can drop into any class. The drop-in fee is $25 for all classes. Certain classes for must be scheduled through the Health Spa app or website in advance and are subject to a cancellation fee within 12 hours of the class.

5. Attire
Members are required to wear appropriate attire for their selected experience. Exercise classes: clothing and shoes that do not interfere with proper form or can cause harm to themselves or others. Health Clinic: full clothing and shoes. Spa and Sauna: bathing suits are accepted. Spa shoes are required.

6. Equipment
All equipment must be used as designed. If member is not familiar with use of equipment, he/she must arrange instruction with a staff member. Instruction is available to clients as a part of their membership. Members must be familiar with and observe Health Spa rules and regulations posted. Members who do not observe Health Spa rules and regulations or who abuse equipment will be asked to leave. The management reserves the right to terminate memberships of anyone who refuses to observe any of the Health Spa’s rules or regulations.

7. Conduct
The Health Spa is committed to the health, safety and welfare of each of its members and staff and will not tolerate unreasonable, threatening, obscene, harassing, indecent, or illegal behavior. The Health Spa has the right to judge behavior and respond accordingly. This right includes, but is not limited to, termination of membership of any client engaging in unacceptable behavior.

8. Lockers
Lockers are available for day use only. Articles left overnight will be removed. The use of cellular phones is not allowed inside locker room, spa or sauna facilities.

9. Children

Members must be 18 years of age or older, unless accompanied by a parent/guardian, in which case 16 years of age can participate.
Childcare for members is open during business hours and special events. It serves children 3 months and up. Children under 3 months of age be always accompanied by their parent and safely harnessed in a stroller or car seat. Health Spa staff will not be responsible for changing diapers or accompanying children to the restroom. A restroom is provided in the children’s area for children able to go independently. Members attending classes have access to childcare for a 3-hour maximum. Members not attending classes have access to childcare for a 2-hour maximum. Parents/Guardians MUST remain on Health Spa campus while their children are childcare. The options for which are:
$50 Unlimited Membership for first child and $10 for each additional child- 3 hour maximum for members attending a class. 2-hour maximum for members enjoying community or that have MRX appointments.
$10 Drop-in for first child and $5 each additional child with a total 2 hour maximum
10. Damages
Members shall pay for any damages to the Health Spa’s property which result from willful or negligent conduct of member, member’s guest, or dependent children.

11. Lost Articles
The Health Spa assumes no responsibility for lost or stolen articles. Lost and found articles not claimed within 30 days will be donated to charity.

12. Smoking, Food and Drink
No smoking is allowed in any part of the facility. Food and drink are restricted to the coffee and juice bar lounge. Water may be used in the workout areas if it is in a closed container.

13. Waiver, Release and Assumption of Risk
All members will be required to sign Health Spa’s Liability Waiver before having access to facilities.

NOTICE TO PURCHASER: DO NOT SIGN THIS CONTRACT UNTIL YOU READ IT OR IF IT CONTAINS BLANK SPACE
IF YOU DECIDE YOU DO NOT WISH TO REMAIN A MEMBER OF THIS HEALTH SPA, YOU MAY CANCEL THIS CONTRACT BY MAILING TO THE HEALTH SPA BY MIDNIGHT OF THE THIRD BUSIESS DAY AFTER THE DAY YOU SIGN THIS CONTRACT A NOTICE STATING YOUR DESIRE TO THE FOLLOWING ADDRESS: 7560 GREENVILLE AVENUE, DALLAS, TX 75231
IF THE HEALTH SPA GOES OUT OF BUSINESS AND DOES NOT PROVIDE FACILITIES WITHIN 10 MILES OF THE FACILITY IN WHICH YOU ARE ENROLLED OR IF THE HEALTH SPA MOVES MORE THAN 10 MILES FROM THE FACILITY IN WHICH YOU ARE ENROLLED, YOU MAY: (A) CANCEL THIS CONTRACT BY MAILING CERTIFIED MAIL A WRITTEN NOTICE STATEING YOUR DESIRE TO CANCEL THIS CONTRACT, ACCOMPANIED BY PROOF OF PAYMENT ON THE CONTRACT TO THE HEALTH SPA AT THE FOLLOWING ADDRESS: 7560 GREENVILLE AVENUE, DALLAS, TX 75231.
FILE A CLAIM FOR A REFUND OF YOUR UNUSED MEMBERSHIP FEES AGAINST THE BOND OR OTHER SECURITY POSTED BY THE HEALTH SPA WITH THE TEXAS SECRETARY OF STATE. TO MAKE A CLAIM AGAINST THE SECURITY PROVIDE A COPY OF YOUR CONTRACT TOGETHER WITH PROOF OF PAYMENTS MADE ON THE CONTRACT TO THE TEXAS SECRETARY OF STATE. THE REQUIRED CLAIM INFORMATION MUST BE RECEIVED BY THE SECRETARY OF STATE NOT LATER THAN THE 90TH DAY AFTER THE DATE OF NOTICE OF THE CLOSURE OR RELOCATION IS FIRST POSTED ON THE SECRETARY OF STATE’S INTERNET WEBSITE.
IF YOU DIE OR BECOME TOTALLY AND PERMANENTLY DISABLED AFTER THE DATE THIS CONTRACT TAKES EFFECT, YOU OR YOUR ESTATE MAY CANCEL THIS CONTRACT AND RECEIVE A PARTIAL REFUND OF YOUR UNUSED MEMBERSHIP FEE BY MAILING A NOTICE TO THE HEALTH SPA STATING YOUR DESIRE TO CANCEL THIS CONTRACT. THE HEALTH SPA MAY REQUIRE PROOF OF DISABILITY OR DEATH. THE WRITTEN NOTICE MUST BE MAILED BY CERTIFIED MAIL TO THE FOLLOWING ADDRESS: 7560 GREENVILLE AVENUE, DALLAS, TX 75231.
Member has read, and fully agrees to the terms of this Agreement and understands and agrees that by signing this Agreement and Liability Waiver, Member has given up considerable future legal rights. Member has signed this Agreement and Liability Waiver freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated to him/her. Member certifies and warrants that he/she is 18 years of age or older and mentally competent to enter into this Agreement.
