SUMITS YOGA MEMPHIS LIABILITY WAIVER 

 

1. I understand there is an inherent risk associated with any exercise program including my voluntary participation in yoga that may result in an injury. The exercises related to yoga will challenge my cardio-respiratory and musculoskeletal systems associated with; the aerobic, anaerobic, strength, power, agility, flexibility, and breathing components of the program. I understand and am aware that the components of exercise/yoga are potentially hazardous and may cause injury and I assume all such risks.

 

2. I acknowledge that I have either had a physical examination and/or have been given permission from my physician to participate in a yoga based exercise program or that I have decided to participate in an exercise program voluntarily and without the approval of my physician and do hereby assume all responsibility for my participation in any exercise/yoga or activity associated with Sumits Yoga Memphis.

 

3. I certify that I am physically well and suffering from no medical problems, conditions, impairments, diseases, or any other illness that would prevent my participation or increase my risk of injury and/or illness as a result of partaking in any exercise/yoga program.

 

4. On occasion, Sumits Yoga Memphis will live stream video footage of class to a private online group accessible by our members only. By signing up for classes or events, I grant Sumits Yoga Memphis, Barefoot Holdings LLC permission to use my likeness and all rights of any kind in any photographs and videos in any and all publications, materials and medium or format now existing or created hereafter without further payment or consideration. I agree that all photographs and videos including copyright therein, become the property of Sumits Yoga Memphis, Barefoot Holdings, LLC. I authorize Barefoot Holdings, LLC to use, edit, copy, publish or exhibit any photo or video for any lawful purpose. I waive any and all right to review any photographs or video or to obtain royalties or payment from the photographs or videos.

 

5. I will let staff of Sumits Yoga Memphis know in advance of each class if I do not wish to have my picture/video made public.

 

 

6. I and my heirs or legal representatives do hereby waive and release Sumits Yoga Memphis, Barefoot Holdings, LLC, its owners, agents, affiliated companies, and its teachers and employees from any and all liability and responsibility from injury , accident, illness, legal and medical fees and costs sustained now or in the future resulting from my participation in any activity or use of any equipment.

 

7. I understand that Sumits Yoga Memphis will provide an area for personal belongings to be held during class however I agree that Sumits Yoga Memphis is in no way responsible for the loss or damage of my belongings while I attend class or am at the facility.

 

8. I certify I am at least 18 years of age, or 16/17 with my parent's signed approval (must present liability release with parent's signature in studio)

 

I acknowledge that I have read this waiver of liability form. I fully understand its terms and conditions, and I understand that I am giving up my right to sue Sumits Yoga Memphis, Barefoot Holdings, LLC, its owners, agents, affiliated companies, and its teachers and employees. I acknowledge I am signing this agreement voluntarily, and intend by my signature to be a complete and unconditional release of liability to the greatest extent allowable by law.

 

CLASS ETIQUETTE AGREEMENT

 

1. I will check in at the front desk before class.

2. I will arrive on time for class (to the best of my ability).

3. I understand that a yoga mat and towel must be used during class.

4. I understand no cell phones or pagers are permitted in class.

5. I understand that I must take off my shoes before entering the practice studio. 6. I will refrain from talking in the practice room.

7. I will refrain from wearing perfume or cologne in class.

8. It is my responsibility to inform the instructor before class of any injuries or medical conditions that I may have.

9. I understand SUMITS YOGA MEMPHIS is not responsible for any lost or stolen items.
